Plaintiff appeals a summary judgment granted in favor of the defendant. The facts are simply stated: plaintiff was eating in defendants restaurant when a window blew in and injured him. Plaintiffs complaint was framed in three counts: negligence (which included res ipsa); implied warranty; and strict liability.
