This matter is before the court on appeal from an order of the district court entered on January 22, 1988 denying a motion by defendant McDonalds Corporation for a judgment notwithstanding the verdict in this personal injury action arising from the injury of plaintiff Elizabeth F. Shuder at a McDonalds restaurant on October 17, 1982 in Virginia Beach, Virginia. We will reverse and remand the matter for entry of an order granting the motion.
